CEPEP Contractor Ordered to Pay Legal Costs After Losing Appeal

The Court of Appeal has ordered CEPEP contractor Eastman Enterprises Limited to pay CEPEP’s legal costs, after ruling the company wrongly bypassed its contract’s dispute resolution process.

The judges found the contractor went straight to court instead of using agreed alternative dispute resolution mechanisms, defeating the purpose of the contract.

While the court overturned a minor referral to the Director of Public Prosecutions, it ruled this did not affect the main decision.

Eastman Enterprises will pay two-thirds of CEPEP’s legal costs, with a small reduction.
