Judge rules in CEPEP’s favour for contracts termination, refers to DPP for fraud claims

A High Court judge has ruled in favour of CEPEP’s claim that a contractor rushed to file a lawsuit for untimely termination of contracts.

Earlier today, Justice Margaret Mohammed ruled that the claim filed by Eastman Enterprise against CEPEP was “premature”, as it failed to comply with the contract’s dispute resolution clause.

This requires the parties to first attempt to settle the matter through mediation.

Justice Mohammed also directed all case documents be sent to the DPP’s office for investigation, due to the serious fraud allegations regarding the contract extension.

The lawsuit was filed after the cancellation of contracts on June 27th, and sought injunction to stop the termination and also claimed damages.

Meanwhile, CEPEP has expressed concern about what it says is “the fraudulent misrepresentation” made to the Board that Cabinet granted approval to extend over 300 contracts.

It claims that it was “deceived” into extending the contracts, thereby exposing the Government of Trinidad and Tobago to $1.4 billion in expenditure..”
