Judge dismisses application by CEPEP contractor for urgent appeal hearing

A Judge has dismissed an application by Eastman Enterprises for an urgent hearing of an appeal.

The company is challenging Justice Margaret Mohammed’s dismissal of a request for an injunction to force CEPEP to rehire recently terminated contractors.

It filed an application for this appeal to be heard on an urgent and expedited basis, citing hardship on the part of dismissed workers.

In a statement, CEPEP says Appeal Judge Justice Nolan Bereaux criticized affidavit evidence presented by the company’s lawyers as not demonstrating any urgency to justify the request for an urgent hearing.

He also allegedly said that there were no cogent circumstances that would allow the appeal to be heard over, above and in priority to other matters before the Court in which other persons have been patiently waiting in the queue.

The substantive appeal will now come up for hearing in the usual manner.
