CCJ dismisses Massy Stores Barbados appeal

The Caribbean Court of Justice has dismissed an appeal by Massy Stores Barbados, upholding a ruling that the company wrongfully dismissed long-serving employee Merton Forde.

Forde was summarily fired after admitting to taking a small quantity of “condemned rice,” but both the Magistrate’s Court and the Court of Appeal found the punishment disproportionate.

In its majority ruling, the CCJ agreed, saying the dismissal failed to follow the company’s own disciplinary procedures and did not meet standards of fairness and proportionality. One judge dissented, arguing the misconduct was serious enough to justify termination
