Eastman Enterprise Ltd will on Friday ask the Court of Appeal to overturn a High Court ruling that paused its lawsuit against the CEPEP Company.
The contractor wants the stay lifted and the matter—stemming from the April termination of more than 300 contracts—sent back to a different High Court judge.
Eastman is also challenging the referral of the case to the DPP, arguing it was improper.
Its legal team has put forward 11 grounds of appeal, contending the judge erred by requiring the dispute to go to mediation first.
The lawsuit follows CEPEP’s cancellation of 336 extended contracts, a move that has sparked significant political controversy.
