Activist challenges parts of the Emergency Powers Regulations

A pre-action protocol letter has reportedly been issued challenging parts of the Emergency Powers Regulations governing the current State of Emergency.

According to media reports, the action is being taken by social activist and blogger, Vishal Persad.

Mr Persad believes the term “public order” was not clearly defined in the regulations, and so, disproportionately limits fundamental rights protected under the Constitution.

The letter also states that Mr Persad’s issue is with this term and that he was not challenging the need for a state of emergency or the remaining regulations.

The pre-action protocol letter was reportedly sent to President Christine Kangaloo and acting Attorney General Stuart Young on January 1st 2025.

They are being asked to make the necessary changes by 4pm on Monday or face High Court action.
